18 U.S.C. § 2257 Compliance Statement

Content Subject to Section 2257

All models, actors, actresses, and other persons that appear in any visual portrayal of actual or simulated sexually explicit conduct appearing on, or otherwise contained in, PollNova were over the age of eighteen (18) years at the time the visual image was produced. Records required for all depictions of actual or simulated sexually explicit conduct as defined by 18 U.S.C. § 2257 are maintained by the individual creators who uploaded such content, and are on file with the appropriate Records Custodian as identified below.

Exemption Statement

POLLNOVA (Business Registry No. 1001524500), located at 2616 Standardbred Dr, Oshawa, Ontario L1L 0S7, Canada, operates as a secondary producer as defined under 18 U.S.C. § 2257 solely with respect to any content that may constitute "sexually explicit conduct" as defined under that statute. PollNova does not independently produce, create, or direct any sexually explicit content. All content uploaded to PollNova is created exclusively by independent creators ("Users"). PollNova's role is limited to providing the technology infrastructure and Platform through which creators publish content directly to their audiences.

All other visual depictions displayed on PollNova are exempt from the provisions of 18 U.S.C. § 2257 because:

1. They do not portray conduct as specifically listed in 18 U.S.C. § 2256(2)(A)(i) through (iv);
2. They do not portray conduct as specifically listed in 18 U.S.C. § 2257A produced after March 19, 2009;
3. They do not portray conduct listed in 18 U.S.C. § 2256(2)(A)(v) produced after March 19, 2009;
4. The visual depictions were created prior to July 3, 1995; or
5. PollNova does not act as a "producer" with respect to the dissemination of such exempt images as that term is defined in 28 C.F.R. § 75.1(c).

Creator Obligations

All creators who upload content to PollNova that may fall within the scope of 18 U.S.C. § 2257 are solely responsible for:

• Verifying and maintaining records of the age and identity of all performers depicted in their content;
• Ensuring that all depicted individuals are at least 18 years of age at the time of content creation;
• Maintaining all required records in the format and for the duration prescribed by 18 U.S.C. § 2257 and 28 C.F.R. Part 75;
• Producing such records upon request by authorised inspecting officials.

By uploading content to PollNova, each creator represents and warrants that they are in full compliance with 18 U.S.C. § 2257 and all applicable regulations thereunder with respect to all content they upload.

Custodian of Records

In accordance with 18 U.S.C. § 2257, records pertaining to content hosted on PollNova are maintained by the individual creators who uploaded such content. All records associated with depictions contained herein, required to be maintained by applicable law, will be made available to authorised inspectors by the Records Custodian at the following location:

Zero Tolerance for Minors

PollNova has a strict zero-tolerance policy regarding any content depicting minors in a sexual manner. Any such content is immediately removed upon discovery, the responsible account is permanently terminated, and the matter is reported to the National Centre for Missing and Exploited Children (NCMEC), the Canadian Centre for Child Protection (C3P), and relevant law enforcement authorities.
